Model Definition of ‘Family Violence’

The Law Council of Australia hosted a National Roundtable entitled ‘Family Violence: Awareness, Education and Training’ (National Roundtable). National Roundtable participants represented Law Council Constituent Bodies, the Family Law Section (FLS), relevant Law Council Advisory Committees, the legal assistance sector (including Women’s Legal Centres), and family violence prevention and survivor support organisations.
A key issue discussed at the National Roundtable was the utility of developing a nationally consistent definition of family violence across and within Australia’s jurisdictions. Roundtable participants agreed that the issues and challenges caused by the differing definitions of family violence between jurisdictions should be addressed and that it was appropriate for the Law Council and its Constituent Bodies to advocate for this with government. The Law Council has developed a Proposed Model Definition of ‘Family Violence’.
