Fourth John Emerson Oration and CLAANZ Annual Lecture

The Charities and Not-for-Profit Committee of the Law Council of Australia’s Legal Practice Section, the Charity Law Association of Australia and New Zealand (CLAANZ) and the University of Sydney Law School hosted the fourth John Emerson Oration and CLAANZ Annual Lecture in Sydney on 29 November 2023.
The Oration was delivered by the Hon Justice Mark Leeming, New South Wales Court of Appeal and Challis Lecturer in Equity Sydney Law School. Justice Leeming is also a member of the editorial boards of the Journal of Equity and the Australian Bar Review and co-author of two leading practitioner texts and a casebook on equity and trusts, and has published widely in the areas of constitutional law, administrative law, equity, trusts and legal history, including his recent book, Common Law, Equity and Statute: A Complex Entangled System (2023).
Justice Leeming spoke about ‘Statutory Eucalypts in the Law of Charity’. The address focussed on the often hidden interaction between statute law and equity as it relates to the law of charity and is available here.
The Oration honours John Emerson AM, who was a Partner for almost four decades of Herbert Smith Freehills. John is a Member of the Order of Australia for services to law and to the community, particularly through the provision of advice to charities and not-for-profit organisations and the development of public administration reform to encourage philanthropy in Australia.
