Rules for Registration and Regulation of Foreign Lawyers and Foreign Law Firms in India

The Law Council of Australia provided a submission to the Bar Council of India’s Committee examining the Rules for Registration and Regulation of Foreign Lawyers and Foreign Law Firms in India (the Rules).

The Law Council has maintained a strong interest in the liberalisation of India’s legal services market over many years, and has previously engaged closely with the Bar Council of India on issues relating to the regulation of foreign lawyers.

The Law Council has long advocated for a more open and reciprocal legal services market in India on the basis that there are mutual benefits for both foreign lawyers and the domestic legal profession in both jurisdictions, and that the availability of integrated transnational legal services plays an essential role in facilitating trade and investment, economic growth and business confidence.

On 16 June 2010, the Bar Council of India and the Law Council entered into a Memorandum of Understanding (MOU) on strengthening legal exchange and friendly cooperation. A further MOU on strengthening legal exchange, transnational legal practice and friendly cooperation was entered into on 26 September 2015.

The comments and recommendations in the submission in relation to the Rules represent preliminary views of the Law Council, collated for the purposes of the Committee’s consultation. The Law Concil is also in the process of collecting further feedback from our constituent bodies, which may inform further recommendations to the Bar Council.
