General Comment No. 27 on Children’s Rights to Access to Justice and Effective Remedies
The Law Council of Australia thanks the United Nations Committee on the Rights of the Child for the opportunity to contribute to the drafting process for the Committee’s General Comment 27.
In combination with children’s criminal justice-related rights (covered in General Comment 24), children’s rights of access to justice and effective remedies are key concerns of the legal profession in Australia. This submission addresses the Committee’s consultation questions regarding enabling factors and strategies (8) and barriers to access (7).
Australia has a mixed record on access to justice and remedies for children. A major highlight is that there are specific, well-functioning children’s courts and Commissioners across the federation. However, Australia lags on youth criminal justice outcomes and legislative implementation of treaties including the Convention on the Rights of the Child (Convention).1
