Consultation on AFCA’s General Insurance Claims Handling Approach

This submission has been prepared by the Australian Consumer Law Committee and National Insurance Law Committee of the Law Council of Australia’s Legal Practice Section.
The Committees welcome the opportunity to make a submission to the Australian Financial Complaints Authority (AFCA) in relation to the consultation on AFCA’s general insurance claims handling approach.
The Law Council congratulates AFCA on the thoroughness and clarity of the general insurance claims handling approach document (the Approach Document) which we consider communicates an extensive range of claims-management issues clearly in a practical and approachable way.
Consistently, with that view, this submission is confined to a few areas that the Committees have identified where there is some scope for additional issues to be raised, or for revision to emphasis or drafting.
