Submission to the Australian Law Reform Commission’s Review of the Future Acts Regime

On 24 July 2025, the Law Council provided a submission to the Australian Law Reform Commission (ALRC) in response to its Discussion Paper for the Review of the Future Acts Regime.

In broad terms, the Future Acts regime regulates acts (such as the grant or renewal of licences or permits and the making of legislation) that impact Native Title rights and interests. The ALRC’s Discussion Paper sought input on 22 questions and 18 proposals for amending the Native Title Act 1993 (Cth) (NTA) and related legislation to improve the regime.

The Law Council submission welcomed many of the ALRC’s proposals and emphasised that the Review presents an opportunity to better align the NTA with international law, especially the United Nations Declaration on the Rights of Indigenous Peoples and the principle of free, prior and informed consent. The submission was informed by input from a number of constituent bodies and an expert informal Working Group. The Secretariat is grateful for these contributions.

The ALRC will now prepare its final report, which is due to the Attorney-General by 8 December 2025.
