This submission seeks to assist by identifying legal and practical issues arising in relation to the consultation questions that, in our experience, may be significant in practice, whether in relation to developers, users, creators or rights holders. The Intellectual Property Committee of the Business Law Section takes the position that the question as to which option(s) are preferable is a matter for those stakeholders.
This submission does not address the interaction of AI with any stand-alone Indigenous cultural and intellectual property right.
